A Chapter 13 bankruptcy is also called a wage earner's plan. It enables individuals with regular income to develop a plan to repay all or part of their debts. Under this chapter, debtors propose a repayment plan to make installments to creditors over three to five years.
Chapter 7 bankruptcy is sometimes called liquidation bankruptcy. A Chapter 7 bankruptcy cancels your debts, but you might have to let the bankruptcy court sell some of your property for the benefit of your creditors. To receive benefits under the Social Security Disability or SSI program, you must have physical or mental health problems severe enough to keep you from working in any regular paying job for at least 12 months.
